Terms of Service

1. Membership

Joining any of the personalized subscription services provided by PokéLX will always be voluntary, based on the expressly free intention of each user. To do this, the user must access the available plans page to make the contribution according to the desired functionalities. Once payment has been confirmed, membership of the services will be formalized and the respective user account will only be granted the features and exclusive elements according to the service selected. For access to be granted, the e-mail address used for the purchase must be linked to our discord.

2. Free and Paid Use

Notwithstanding the benefits that PokéLX will confer on user accounts associated with a personalized subscription service, there is the possibility of using the service free of charge, in which case the user may enjoy the service in accordance with the rules applied to free access.

• 2.1. Duration and scope. The different personalized subscription services vary in their duration and scope, to the extent that their period of assignment to the account may vary from 1 month to a period of 3 months, as well as the functionalities and elements conferred by each subscription may vary in their quantity and scope in the service.

• 2.2. Payment Methods. For payment of the amount associated with each of the personalized subscription services, PokéLX accepts payments via the Stripe platform (Apple Pay, Google Pay, Visa, MasterCard and PayPal) as specified on the available plans page. Other payment methods with manual contribution may be accepted for an extra monthly fee, for more information see our Official Discord available at https://discord.pokelx.com. The different payment methods aim to offer users greater versatility and, above all, to simplify the purchasing process.

• 2.3. Cancellation. If the user chooses to cancel their subscription, they may do so, without giving any reason, within 14 days of the date on which they received confirmation of their subscription (art. 17 of Decree-Law no. 24/201). This measure only applies to the first month of subscription. Recurring contributors are aware of the risks involved and are not entitled to a refund.

• 2.4. Price changes. PokéLX reserves the right to change subscription prices from time to time. However, changes to the user's subscription prices or services will only be applied to purchases made after communication and entry into force of the different price list, i.e. price changes will never retroactively influence any user purchase.

3. Service usage

The service is entitled to exclusive alerts and exclusive chats regarding the systems available and facilitated by it. Whenever you log in, you agree to use these features only to publish, send and receive messages deemed appropriate and non-offensive, recognizing that you will always be responsible for the information, research, results, messages or other materials you publish and the consequences of their publication. In particular, but without limitation, you agree that while using the service you will not:

• Using the service for contests, pyramid schemes, chain letters, or distributing unsolicited e-mail to third parties for commercial use;

• Defame, abuse, attack, threaten, post racial, ethnic or otherwise objectionable comments, or otherwise violate the safety and/or legal rights (such as rights of privacy and publicity) of third parties;

• Publish, distribute or disseminate any material or information that:

  • is inappropriate, profane, defamatory, obscene, indecent or illegal in topic, name, material or information;

  • is a false statement about a person or their property that is made out of malice and could cause financial damage to that person;

  • is misleading or illusory;

  • is a breach of confidentiality or an invasion of a person's right to privacy;

  • may cause a violation by PokéLX, or involve us in the violation of a law, code or instrument regulating our conduct;

• Transmitting materials that contain or disseminate viruses, worms, time bombs, corrupted files, or any other corrupted software;

• To advertise, promote or offer for sale or purchase any products or services for any commercial purpose;

• Violating any code of conduct or other PokéLX guidelines;

• Collect or otherwise obtain personal information about other individuals in order to send unsolicited e-mails or to exchange personal information about third parties;

• Violate, or encourage others to violate, any laws or regulations or legal rights of third parties;

• Creating a false identity, or pretending to be any person or entity, to deceive others or for any other purpose;

• Refusing to follow the instructions of any PokéLX administrator;

• Sharing your PokéLX account information with others;

• Disclose information that belongs exclusively to the PokéLX service;

• Using third-party applications with the aim of gaining an advantage over other players, such as spoofing, we recommend that alternative tools are not used, the discovery of users who resort to spoofing will have their accounts suspended from PokéLX services;

• Trespassing on private property of any kind involving moral and/or physical damage. We encourage common sense, we are not responsible for any damage caused by members or problems that members may have by trespassing on private premises/etc. Do not enter private property and respect nature and others.

4. Passwords

The user is responsible for any activity that occurs through the user account used to enjoy the PokéLX subscription services. In order to maintain control of your account and prevent unauthorized access by third parties, you must never reveal the password associated with the account to third parties; staff members will never ask for your password. PokéLX may cancel or suspend your account to protect you or its own services against identity theft or other fraudulent practices.

5. Miscellaneous

• 5.1. Legislation in Force. These Terms of Service shall be governed by and construed in accordance with the laws of Portugal. These terms do not constitute any limitation on the consumer protection rights provided for in the laws of your country of residence.

• 5.3. Reduction. In the event that any provision, or provisions, in these Terms of Use is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain valid and in force.

• 5.4. Changes to the Terms of Use. PokéLX may, from time to time, change these Terms of Service. All users must be notified at least 7 days in advance of the application of such changes.

• 5.5. Electronic Communications. PokéLX will send confirmation of your subscription at the time of purchase only via Discord messages to the account indicated during purchase.
